# Consent to the processing of personal data

# INFORMATION AND CONSENT DECLARATION


regarding the processing of the customer’s personal data

This Declaration has been drawn up in accordance with Law No. 195/2024 on Personal Data Protection, effective from 23 August 2026. It supplements the SPORT SPIRIT S.R.L. Personal Data Processing Policy, available on the Company’s website and/or at its points of sale.

- Processing That Does Not Require the Customer’s ConsentThe customer is informed that SPORT SPIRIT S.R.L. may process strictly necessary data without requesting separate consent where another legal basis provided by law applies, including for:• creating and administering the customer account, receiving, confirming and fulfilling orders;• delivering products and sending operational communications concerning the order; for delivery purposes, the necessary data may be disclosed to the courier service provider, including FUN COURIER;• processing payments and refunds, issuing tax and accounting documents and complying with obligations prescribed by law;• returns, exchanges, warranties, complaints and handling customer requests;• administering the loyalty program, to the extent that processing is necessary for the performance of the program rules;• ensuring system security, preventing fraud and protecting the Company’s rights and legitimate interests, subject to the applicable legal requirements.Refusal to provide data that is objectively necessary for entering into or performing a contract may make it impossible to place or deliver an order or provide the requested service.

- Optional Consent to Commercial CommunicationsConsent to marketing is voluntary and separate from the purchase of products and participation in the loyalty program. - Withdrawal of Consent and Objection to MarketingThe customer may withdraw their consent at any time, free of charge and as easily as it was given, by using the unsubscribe link in an e-mail, the mechanism indicated in an SMS, or by submitting a request to SPORT SPIRIT S.R.L. using the contact details provided above. Withdrawal takes effect for the future and does not affect the lawfulness of processing carried out before the withdrawal.Following withdrawal, SPORT SPIRIT S.R.L. may retain strictly necessary data in a suppression list solely for the purpose of preventing unwanted commercial communications from being sent again.

- Recipients and Service ProvidersTo the extent necessary to fulfil the purposes described above, data may be disclosed to courier service providers (including FUN COURIER), payment service providers, IT/hosting providers, CRM/loyalty service providers, e-mail/SMS service providers, professional advisers and competent authorities, in accordance with Law No. 195/2024 and the SPORT SPIRIT S.R.L. Privacy Policy.

- Data Subject RightsUnder Law No. 195/2024, the customer may, where applicable, exercise the right to information, access, rectification, erasure, restriction of processing, data portability, objection, withdrawal of consent, as well as the rights applicable to automated individual decision-making. The customer may lodge a complaint with the National Centre for Personal Data Protection (CNPDCP) and may bring proceedings before the competent court.
